SANTIAGO (WiMAX Day). WiMAX is at the centre of a courtroom drama in Chile as the Mexican telecommunications giant Telmex has filed suit against the Chilean subsidiary of Telefonica. Telmex alleges that Telefonica was instrumental in delaying the Telmex’s award of a license to 3.5 GHz WiMAX spectrum from 2004 to 2007. At the Chilean Competition Tribunal, Telmex said that after it was awarded the spectrum at auction in 2004, Telefonica intentionally “started a long trial process that went on until November 2006 when the court of appeals ruled in favor of the ministry of telecommunications,” a Telmex spokesman told Reuters. Telmex was finally awarded the spectrum in January 2007.
